American journalist EJ Carroll, who accused Donald Trump of raping her in the 1990s, today (Thursday) launched a civil case against the former President of the United States thanks to a new New York law protecting victims of sexual assault.
A dual rape and defamation lawsuit filed by Carroll, 78, against Trump, 76, has been pending in federal civil court in Manhattan since 2019. They each testified under oath before a New York judge in October.
In the defamation case, EJ Carroll, an author and former Elle magazine columnist, filed a civil lawsuit against Trump in November 2019. She accused him of defaming her for describing her rape allegations in a New York dressing room in 1995 or 1996. It was a “total lie” in June 2019.
The Republican president, who was in office at the time (2017-2021), responded that he had never met her and that she “doesn’t like” him. His lawyers claimed he was protected in 2019 thanks to his immunity as President of the United States.
Regarding the rape allegations, Carroll was unable to file a formal complaint in 2019 because the alleged facts were out of date. But on November 24, a new New York state law went into effect that gives victims of sexual assault a year to reactivate potential old complaints and file a civil lawsuit.
The law firm Kaplan Hecker & Fink, whose services Carroll employed, and the Manhattan federal judiciary released (Thursday) several court documents accusing Trump of “rape” and seeking a civil trial in 2023 to seek damages.
In today’s preface to the lawsuit, which lists all the facts, Donald Trump is accused of “27 years ago (…) grabbing Jean Carroll at the luxury goods store Bergdorf Goodman on Fifth Avenue in New York, nailing her to the wall by his shoulder a dressing room and raped her.”
Carroll remained silent for over 20 years before recounting her story in a book in late 2010 with the rise of the “#MeToo” movement, launched in 2017 to oppose violence against women.
Alina Heba, Trump’s lawyer, told Agence France-Presse (Thursday): “While I respect and admire people who speak out, unfortunately this case represents a distortion of the aim of the law that sets a dangerous precedent and the Legitimacy can delegitimize testimonies of the true victims.”
In October, the former president called the allegations “a hoax and a lie”.
And this October 12 re-defamation of Trump on his Truth Social website, which mocks this alleged rape, also allows Carroll to remove the libel portion of the lawsuit she filed against Trump, this time accused as a private individual, without saying so remove presidential immunity.
